British court rejects motion of three Poles against extradition

November 2nd, 2018

The Administrative Court of the Queen's Bench Division of the High Court rejected motions by three Polish nationals, all subject to European Arrest Warrants (EAW), who challenged their extradition to Poland. All three applicants stated that recent changes have so damaged judicial independence that the criminal proceedings in Poland to which they would return if extradited will entail a real risk of breaches of the right to a fair trial under Article 6 of the European Convention on Human Rights. The court announced that there were no "exceptional circumstances" in which their cases could justify a ruling denying their extradition.
